EU Artificial Intelligence Act Expertise

From the 2nd February 2025, companies must comply to avoid the risk of fines up to €35m or 7% of worldwide annual turnover for severe violations

The EU AI Act is a comprehensive regulatory framework, since August 2024, for safe and ethical AI in the EU and with obligations applicable to the UK and rest of the world.

2nd February 2025 obligations:

  • Ban on AI systems posing unacceptable risks

  • Requirement for adequate AI literacy among relevant employees

 

While most obligations come into full effect in August 2025 and 2026, HR departments should start preparing now, given the complexity and scope of the requirements.

Ban on unacceptable Risk AI Systems

HR teams must cease using any AI systems categorized as posing "unacceptable risk".

This includes:

  • AI systems for social scoring

  • Exploitative or manipulative AI

  • AI for untargeted scraping of facial images

  • AI that categorizes people to their detriment

AI Literacy Obligations

The most immediate requirement is ensuring AI literacy among staff involved in AI operations and use.

  • HR must implement measures to provide employees with sufficient AI literacy

  • This applies to all AI systems, regardless of risk level

  • Training should align with staff's technical knowledge and the context of AI use

High-Risk AI in HR Actions

The EU AI Act defines AI activities in recruitment, HR, and worker management as "high-risk". For these systems, HR teams must:

  • Implement appropriate risk management process

  • Ensure data sets are unbiased & fit 4 purpose

  • Maintain technical documentation and human oversight

  • Complete conformity assessments

  • Register high-risk AI systems in EU database

Compliance & Accountability

HR teams should:

  • Review current AI practices for compliance

  • Develop processes for ongoing monitoring and correction of AI systems

  • Prepare for potential audits and enforcement actions
